David Paget has extensive experience in environmental
law and related litigation, particularly in preparing
and processing environmental impact statements and permits
pursuant to the Clean Air Act, the Clean Water Act,
the National Environmental Policy Act (NEPA), National
Historic Preservation Act and their New York State counterparts.
David began litigating and managing environmental cases
in the early 1970s following his service as an Assistant
United States Attorney for the Southern District of
New York.
Among the many projects and undertakings in which David
has been a central participant in the preparation of
environmental impact statements and in obtaining related
permits and approvals, and successfully defending legal
challenges to those projects, are:
- The approval and development of Brooklyn Bridge
Park.
- The approval and development of a new Yankee Stadium.
- The expansion of the United States Tennis Association
facilities in Flushing Meadows, Corona Park, New York
City.
- The approval and development of Hudson River Park.
- The approval of a major renovation of the Seventh
Regiment Armory.
- Major residential and mixed use developments, including
Battery Park City, Riverside South, Queens West, the
Davids Island project in New Rochelle, New York and
the Tuxedo Reserve project in Tuxedo, New York.
- Major economic and other development projects in
the City of New York and elsewhere, including Silvercup
West, One Bryant Park, Seven World Trade Center, Governors
Island, the original New York City Convention Center
and its currently proposed expansion, the Downtown
Brooklyn Rezoning, the 42nd Street Redevelopment,
Metro Tech, Gateway Estates at Starrett City, South
Street Seaport, the Marriott Marquis Hotel, Morgan
Stanley, the expansion of Northern Westchester Hospital,
the New York Times major printing plant, the Harlem
River Yards inter-modal facility, the Palisades Mall,
the Olympus project in the Town of Huntington, the
New York Hospital development in White Plains, the
Harlem Valley, New York light industrial park, the
Cadillac Square shopping mall development in Detroit,
Michigan, the Tanger Outlet Mall and the Traditional
Links golf and residential project, both in Riverhead,
New York.
- Major infrastructure projects, including, currently,
the Tappan Zee Bridge I-287 Corridor project.
- Resource recovery and cogeneration projects in New
York City, Hempstead, North Hempstead, Oyster Bay
and Albany, New York.
- The environmental assessment and disposition by
New York State of all of its mental health care facilities
and campuses.
- The representation of major participants in the
solid waste collection and disposal sector.

David has been the long-standing co-chairman of the
annual ABA/ELI program on the National Environmental
Policy Act and State Environmental Review Acts. He has
served on the faculty for the American Bar Association/Environmental
Law Institute ("ABA/ELI") Environmental Litigation program
and for the Practicing Law Institute's program on Historic
Preservation. He has co-chaired programs on Resource
Recovery Facilities for the United States Conference
of Mayors. He was the co-chairman of the Practicing
Law Institute's program on Retail Property Development
and a participant in its program on Negotiating the
Sophisticated Real Estate Sale Transaction. He has also
been a lecturer on Trial Advocacy and also has lectured
on environmental law at Columbia Law School, New York
University School of Law, Fordham Law School, Pace University
School of Law and seminars sponsored by the American
Planning Association.
