The court rejected the principal contentions advanced by petitioners and found: <ol> <li>There was no violation of the public trust doctrine by including residential/commercial development as part of the overall Brooklyn Bridge Park Project so that the Park could be financially self-sustaining. Moreover, the court found that the parcels to be put to such use were never parkland and their use as residential/commercial did not constitute alienation of parkland. </li> <li>There was no violation of the State-City MOU because that document contemplated a self-sustaining project. Moreover, the MOU was only a guideline subject to further refinement as the process progressed and resulted in a General Project Plan adopted by ESDC that provided for the self-sustaining Park. </li> <li>There was no contravention of SEQRA, as (a) their EIS was not required to evaluate as a reasonable alternative to the Project an illustrative master plan that was impractical to implement, and (b) the Project was unrelated to the Atlantic Yards project and the EIS need not have considered the two projects together. </li> </ol> The court noted, in the concluding paragraphs of its decision, that the case reflected a political disagreement -- petitioners' philosophical position that public parks should not be burdened with the costs of their maintenance but should be supported at public expense, versus the State/City determination that the Park should be self-sustaining. The court properly noted that this was a political question, to be decided in the political arena, and was not an issue susceptible to judicial resolution. </p> <p> <a href="http://nycourts.law.com/CourtDocumentViewer.asp?view=Document&docID=77026" target="_blank">Click here</a> for the full text of the Brooklyn Bridge Park decision. <br> (requires a subscription to New York Law Journal Online)</p> </td> </tr> <tr> <td class="regular_text" height="30" valign="top"> <img height="30" src="images/_spacer.gif" width="1"></td> </tr> <tr> <td class="regular_text" valign="top"> <p> <b><u>New York Yankees:</u></b></p> <p> The Firm represents the Yankees with respect to the construction of a new Yankee Stadium in the Bronx, across the street from the existing stadium, which is slated to be completed for Opening Day 2009. The new stadium project was overwhelmingly approved by the New York City Council in April 2006. In September, the Firm won a major victory when the New York State Supreme Court denied project opponents a preliminary injunction that would have stopped construction of the stadium. In so doing, the Court found that the opponents were not likely to succeed on the merits of their claims that the environmental review for the project was deficient. The Court also found that while the plaintiffs would not be irreparably harmed if project construction continued, the City and the Yankees would be severely injured by an injunction in light of the important benefits the stadium project will confer on the Bronx and the City. The Firm continues to litigate on behalf of the Yankees in a second lawsuit brought by stadium opponents in federal court. The federal court has already denied the opponents a temporary restraining order, which they sought in an effort to stop construction while the court decides whether a preliminary injunction should be granted. In recent years, it has fallen into a serious state of disrepair. The Firm represents the Seventh Regiment Armory Conservancy with respect to its plans to restore and rehabilitate the Armory and subsequently to operate it as a visual and performing arts venue, as well as continuing to host the art and antique fairs for which it is well known. In November 2005, the Empire State Development Corporation approved the Conservancy s plans, following which project opponents filed suit in the New York State Supreme Court seeking to overturn that approval on environmental grounds.
